This Legal Notice regulates the use of the web service www.everlove.es (hereinafter, the “Web”) that David Ruiz Gonzalez width DNI 50853081n makes available to Internet users.
The Web allows you to manage the online purchase of Everlove clothing and accessories; as well as, know -first hand-, the trends of the season, through push notifications, if you wish.
The Web is exclusively aimed at a public over 18 years old.

The everlove.es domain names can not be used in connection with other products or services that are not owned by the owner, and can not be used in any way that could cause confusion among our customers or discredit the owner.
3. LIMITATION OF RESPONSIBILITIES
The owner is exempt from any liability arising from:
a. Failures on the Web due to force majeure, fortuitous events or other causes not attributable to it.
b. Technical and / or mechanical problems or viruses produced during the connection to the Internet (either through the Everlove, SL or third-party platforms website), in the computer systems (software and hardware) or in the stored electronic documents and files on computer equipment.

5. MODIFICATION OF CONDITIONS
The owner can modify this Legal Notice if he makes his communication to the Users, a requirement that the parties expressly agree that it is understood to be fulfilled with the publication of the variations through the Web.
GENERAL CONDITIONS OF PURCHASE
These General Conditions of Purchase regulate the use of the web everlove.es (hereinafter “The Web”) of which David Ruiz Gonzalez (hereinafter the owner) is the owner. The use by the customer of the services of the online store presupposes, in any case, adherence to the General Purchase Conditions in the version published at the time of the purchase order. Therefore, it is convenient that the customer read these General Conditions before proceeding to make a purchase.
1. SCOPE OF THE CONTRACT
These General Purchase Conditions apply to the sale of all Everlove items through its website, to consumers to whom orders can be delivered in Europe (euro zone only). Everlove reports that its website is exclusively aimed at an audience over 18 years old. Everlove reserves the right to cancel a customer’s access account if fraudulent, speculative or bad faith acts are detected in the use of this service.
2. PURCHASE LIMIT.
For security reasons, purchases over € 1,500 can not be made or with more than 25 items per order.
3. PRICE.
The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article and include the I.V.A (Value Added Tax), IGIC (General Indirect Canarian Tax), or IPSI (Tax on Production, Services and Importation in Ceuta and Melilla), as appropriate. The amount of the shipping costs is indicated to the customer in a disaggregated way at the moment of placing the order.
4. PAYMENT.
The payment will be made at the end of the purchase process and will be an essential condition for the formalization of the same. In no case can the payment be made later. Payment is not admitted through deferred procedures such as cash on delivery, transfer or payment in the store at the time the order is collected. Supported means of payment: Purchases can be paid with a Visa®, MasterCard® credit card as well as with a 4B or 4B Maestro debit card. In any case, the choice of means of payment is made during the purchase process in the corresponding screen.
The customer must notify Everlove of any undue or fraudulent charge on the card used for purchases, by email or by telephone, in the shortest possible time so that he can make the necessary arrangements. The suppliers or issuers of means of payment can adopt anti-fraud measures that entail the rejection of certain types of operations. Everlove is not responsible for the application of this type of security policy.
5. DELIVERY.
The delivery time will be a maximum of 30 calendar days from the completion of the purchase. The delivery of orders will be made at the address indicated by the customer, taking into account the following characteristics:
5.1 Home delivery:
Standard shipping: The customer must pay the transport costs: up to 5 kg, € 6 in the Peninsula, € 12 in the Balearic Islands, Canary Islands, Ceuta and Melilla and € 16 in the countries where shipments are made in the rest of Europe.
-In the case of shipments to Ceuta and Melilla, the client must also pay the customs and taxes that generate the order. These expenses are paid at the time the order is received and in no case will be included in the price paid for the products.
-In the case of shipments to the Canary Islands, the customer must also pay the management fees at the Customs office that generates the order (€ 8) and the AEIM regardless of the amount of the order when appropriate. In addition, the customer must pay the corresponding tax. These expenses are paid at the time the order is received and in no case will be included in the price paid for the products.
The address indicated by the client may be a private address, a place of work or any other address indicated. It is not necessary that the billing address and shipping address match. 5.2 Incidents in the delivery:
In case of not being able to make the delivery due to absence of the recipient, the transport agency will leave an indicative note and try to contact by telephone with the recipient. After two unsuccessful attempts, the client must contact the transport agency to proceed with the delivery.
6. CHANGES, RETURNS AND WITHDRAWAL.
There are different procedures for making changes, refunds and withdrawals. Next, we will describe the characteristics of each of them, as well as their costs and conditions.
a. Change: Replacement is considered change for the same product in another color and / or size.
b. Return: in case of tare or defect.
c. Withdrawal: by decision of the client.
All products that are to be exchanged or returned must be properly packaged.
In case of withdrawal, you will only be responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and operation of the goods.
6.1 CONDITIONS, REIMBURSEMENT AND PROCEDURE.

Conditions (Returns): Everlove will answer for the lack of conformity that is manifested within the term established in the legal regulations.
Refund: Everlove will reimburse, if applicable, the corresponding amount, including the standard shipping costs of the initial delivery without undue delay and, in any case, before 14 calendar days have elapsed from the date on which it was informed of the return. The refund will be made by the same means of payment with which it was paid. However, we can withhold reimbursement until we have received the goods, or until you have submitted proof of the return of the goods, depending on which condition is met first.

7. AVAILABILITY OF THE PRODUCTS.
If there are incidents regarding its supply or if there are no products in stock, the customer will be informed immediately and the amount of the product or products without stock will be reimbursed. Everlove will reimburse the corresponding amount without undue delay and, in any case, before 14 calendar days have elapsed. The refund will be made by the same means of payment with which it was paid. The physical store stock availability data that is reflected on our website are indicative and may vary.
8. WARRANTY OF PRODUCTS PURCHASED.
The guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users.

Everlove reserves the right to modify these General Purchase Conditions at any time. No change will affect orders that are already in progress.
11. FORCE MAJEURE.
Compliance by Everlove of all or part of its obligations will be suspended in the event of a fortuitous event or force majeure that prevents or delays compliance. They will be considered as such, in particular, without this list being limiting: war, riots, insurrection, social unrest, strikes of any nature and supply problems not attributable to Everlove. Everlove will inform the customer of such a fortuitous event or force majeure within seven days after its occurrence. In the event that such suspension is prolonged beyond a period of fifteen days, the client will then have the possibility to rescind the current order and then proceed to reimbursement under the conditions set out in point 6 of these General Conditions shopping.
12. APPLICABLE LAW AND JURIDISCTION.
These General Purchase Conditions are subject to Spanish legislation. Notwithstanding the foregoing, the consumer not resident in Spain also enjoys the protection guaranteed by the mandatory provisions of the law of the country where he has his habitual residence. The parties submit, at their election, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the client’s domicile.
